Not because one global law solved everything, but because enough concrete obligations now exist that you can no longer separate product design from compliance design. U.S. federal policy is still fragmented, but state-level requirements are now concrete enough to force implementation choices. Meanwhile, voluntary frameworks like NIST remain influential in procurement, audit posture, and enterprise policy.
This combination matters because enterprise teams do not operate in one legal silo. They operate across customers, markets, and risk tolerances.
The Dates That Actually Matter
These are the dates I keep in front of teams because they anchor planning.
- August 1, 2024: EU AI Act entered into force.
- February 2, 2025: first EU AI Act rules applied (including prohibited practices and AI literacy obligations).
- August 2, 2025: EU governance rules and GPAI obligations became applicable.
- January 1, 2026: California AB 2013 training data transparency disclosures became due.
- June 30, 2026: Colorado SB24-205 obligations, as delayed by SB25B-004, are set to apply.
- August 2, 2026: EU AI Act transparency obligations under Article 50 become applicable.
If your roadmap does not map to these dates, you are planning blind.
EU Direction: Structured, Staged, and Expanding
The EU path is clear: transparency is not optional and not narrow. Article 50 obligations become applicable on August 2, 2026, with ongoing work on practical implementation support, including the code of practice process around marking and labeling AI-generated or manipulated content. From an engineering perspective, EU direction rewards teams that already have:
- machine-readable content provenance,
- robust labeling pathways for synthetic media,
- disclosure controls at deployment surfaces,
- and documented governance process.
If you wait for final interpretive comfort before building these, you will run out of time.
California Direction: Disclosure and Frontier Accountability
California now gives us two different transparency patterns that matter for builders. First, AB 2013 requires developers of covered generative systems to post high-level training data documentation, with recurring obligations when substantial modifications are released. Second, SB 53, signed September 29, 2025, created the Transparency in Frontier Artificial Intelligence Act framework with requirements around frontier risk frameworks, reporting pathways for critical safety incidents, and whistleblower protections tied to catastrophic-risk contexts. These are not the same obligation type. AB 2013 pushes dataset and training transparency. SB 53 pushes frontier risk governance and incident accountability.
Together they show where policy is going: document what you built from, and document how you govern what it can do.
Colorado Direction: Consumer-Facing Transparency and Risk
Colorado remains important because it pushes deployer and developer responsibilities in consumer interactions, including disclosure obligations when people interact with AI systems. The timeline has moved. A 2025 change shifted effective timing to June 30, 2026 for core requirements. That date shift fooled some teams into pausing preparation. I think that is a mistake. Even where dates move, direction stays consistent: explain where AI is present, evaluate discrimination risk in consequential contexts, and maintain process evidence.
U.S. Federal Reality: No Single Comprehensive Law Yet
As of February 11, 2026, there is still no unified U.S. federal AI transparency law equivalent to the full EU regime. But that does not mean "no enforcement risk." The FTC continues to pursue deceptive AI claims and bias-related misrepresentation under existing authority, and NIST frameworks continue to shape what "reasonable" governance looks like in enterprise and public-sector procurement contexts. So the practical federal signal is this: even before one omnibus law, weak transparency can still become legal and commercial liability.
What Teams Need to Build Now
If you want one practical checklist, this is mine.

Create a consistent way to tag and trace AI-generated content and transformations.
- Model and data disclosures
Maintain versioned model cards, training-data summaries where required, and release-change logs.
- Interaction disclosure controls
Ensure user-facing systems can reliably disclose when users are interacting with AI.
- Incident reporting pathways
Define what counts as a reportable safety incident and who owns response timelines.
- Risk assessment workflow
Run recurring impact and bias assessments on high-consequence workflows.
- Governance logs
Keep auditable records of policy checks, overrides, exceptions, and approvals.
- Cross-jurisdiction mapping
Map obligations by geography and product surface, then route controls accordingly.
None of this is glamorous. All of it compounds.
The Cultural Shift That Has to Happen
The deepest change is not legal. It is organizational. Transparency work cannot live only in legal or policy teams. It has to be co-owned by product, engineering, security, and operations. If those functions are not working from the same system map, transparency breaks at handoffs.
The teams that do this well treat compliance artifacts as byproducts of good engineering, not paperwork added at the end.
Where This Is Heading
I expect three trends over the next 18 to 24 months. First, more machine-readable disclosure expectations, not just human-readable policy pages. Second, tighter coupling between transparency and safety incident reporting. Third, higher pressure for independent validation of claims, especially for high-impact systems. In other words, we are moving from "say what you do" to "show what happened."
